Department of Labor and Employment (DOLE)

The Department of Labor and Employment (DOLE) is the Philippine national government agency mandated to formulate policies and regulations and implement programs in labor and employment. The Agency is tasked with the implementation of the Labor Code and other Labor Laws that ensures fair and just labor practices.

Issuances of the Department of Labor and Employment (DOLE)

What are the different classifications of issuances of the Department of Labor and Employment (DOLE)?

Department Order and Labor Advisories issued by DOLE are the usual issuance for the public. However, there are also other types of issuances that are internal to the department but are publicly issued if it contains guidelines for the benefit of the general public. The following are different types of issuances by the DOLE:

Department Order

Department Orders issued by DOLE often involves issuing or amending implementing rules and regulations of the Labor Code and other labor laws. All implementing Rules and Regulations are issued under Department Orders.

An example of this is Department Order No. 147, series of 2015 which amends the implementing rules and regulations of Book VI of the Labor Code of the Philippines.

Labor Advisory

Labor Advisories are issued for guidance of processes and payment of wages for holidays or special-non working days. These issuances are for the general consumption of the public and should be monitored by Human Resource (HR) Officers.

Labor Advisories are often clarifications or additional guidance to Department Orders.

Department Advisory

Department Advisories issued by DOLE often involve internal policies and practices within the department. A department advisory may be used to further add aspects to a Joint Issuances. Documents are publicized only to the public if needed.

An example of a Department Advisory No. 01, series of 2019 regarding the computation of Salary Differential for the Expanded Maternity Benefit of which the original is a Joint Issuance.

Department Circular

Department Circulars issued by DOLE often involve clarifying internal policies and practices within the department. Documents are publicized only to the public if needed.

An example of this is Department Circular No. 1, series of 2017 clarifying the applicability of Department Order No. 174, series of 2017.

Advisories are internal issuances for clarifications or guidance to the Regional Offices,
